Welcome to BLKCHP.COM -  Please read these Terms and Conditions carefully. By accessing our website or making a purchase, The Buyer, User, Subscriber hereafter known as “Customer” acknowledges to have read, understood, and agrees to be bound by the following terms and conditions:

 

General Terms

  1. Use of Website: BLKCHP.COM, Us, We, hereafter referred to as “Company” or “BLKCHP.COM”,  its Company Sites are intended for personal, non-commercial use only. Customer agrees to use the website in accordance with all applicable laws and regulations and refrain from engaging in any activities that may compromise the security or functionality of the website.

  2. Eligibility: By using our website or making a purchase, Customer affirm that Customer is at least 18 years old or have the legal capacity to enter into binding Agreements. If Customer is under 18, Customer may only use our website or make a purchase with the involvement and consent of a parent or legal guardian.

Product Information​

  1. Product Descriptions: We strive to provide accurate and up-to-date information about our products. However, we do not warrant that the descriptions, images, specifications, or other content on our website are error-free, complete, or current. Product availability is subject to change without notice.

  2. Pricing: All product prices are listed in the currency specified on our website and are subject to change without notice. We make efforts to ensure the accuracy of pricing, but errors may occur. In such cases, we reserve the right to cancel or modify orders containing incorrect prices.

  3. Product Customization: Company offers customizable Gaming PCs. While we strive to fulfill customization requests accurately, we reserve the right to make minor adjustments or substitutions to meet technical requirements or improve overall performance.

 

Ordering and Payment

  1. Order Placement: Placing an order on our website constitutes an offer to purchase the selected product(s). We reserve the right to accept or decline orders at our discretion. Once an order is placed, Customer will receive an email confirmation containing Customer order details.

  2. Once Customer places an order with Company, please allow 72 hours or three (3) business days for orders placed over weekends and/or holidays for order processing and verification. During peak periods or promotional campaigns, order processing may take slightly longer due to increased demand.

  3. Payment: Company accepts payment through authorized payment methods specified on our website. Customer agrees to provide accurate and complete payment information. Payment must be received in full before Customer order is processed and shipped. All Sales Are Final.

Modifications and Cancellations

  1.  If Customer wishes to modify or cancel an order after it has been placed, please contact our customer support team as soon as possible. We will do our best to accommodate any reasonable request, but please note that order modifications or cancellations may not be possible if the request is received more than 72 hours after order is placed. 


 

Shipping Policy

  1. Company currently services to the United States, United Kingdom, and Europe. Delivery Destination will affect final pricing and delivery times. Shipping and carrier rates may vary. Shipping fees from purchase will not be refunded in any way.

  2. Once Customer places an order with Company, please allow 72 hours or three (3) business days for orders placed over weekends and/or holidays for order processing and verification. During peak periods or promotional campaigns, order processing may take slightly longer due to increased demand.

Order Tracking

  1. Once Customer order has been shipped, Customer will receive a shipping confirmation email containing a tracking number. Tracking number allows Customers to monitor the status of Customer shipment on the carrier's website.

  2. Please ensure that accurate and complete shipping information is available during the checkout process. Company is not responsible for any delays or additional costs incurred due to incorrect or incomplete shipping addresses provided by customers.

  3. Company takes utmost care in packaging and shipping the products we offer. However, additional shipping insurance is available. Please note that shipping insurance is optional and additional charges may apply.

  4. Shipping Policy: Company offers shipping services to select locations. Shipping options, fees, and estimated delivery times will be provided during the checkout process. Delivery times are estimates and are subject to factors beyond our control, including but not limited to customs procedures and carrier delays.

  5. Risk of Loss: The risk of loss and title for products purchased from Company pass to Customer upon our delivery to the carrier. We are not responsible for any damage, loss, or delay caused during transit.

  6.  Shipping fees will not be refunded in any way.

Refunds: All Sales Are Final.

  1. Any Refunds will be issued as a “Store Credit” in accordance with this policy. We reserve the right to refuse or deduct a portion of the refund i.e. “Store Credit” if the returned product is not in its original condition or fails to meet the requirements as outlined herein.

Warranty Length : 12 months after completion of purchase 

  1. Customer right to warranty above what is offered by Company may vary. All sales are completed in accordance with the Laws of the State of South Carolina, and subject to regulations in the aforementioned jurisdiction. 

  2. All new Company computers have a 12 month warranty included with every purchase. This can be lengthened by purchasing an extended warranty before checkout when buying a computer.

All Company-branded Certified Refurbished products carry a 90 day warranty from the date of purchase for parts and labor.

  1. In the event that warranty repair or replacement is necessary within the 12 months after completed purchase (warranty period), Customer must contact Company at: TechSupport@blkchp.com Making sure to reference proof of purchase (Shop receipt or invoice), RMA number, date of purchase and operational issues with the system, or product under warranty.  Company will make every effort to reply to all inquiries within 48 hours of receiving the initial email. 

  2. The Warranty covers only Company products purchased by the original consumer, unless otherwise stated.

  3. Customer right to warranty above what is offered by Company may vary. All sales are completed in accordance with the Laws of the State of South Carolina, and subject to regulations in the aforementioned jurisdiction. 

  4. In the event that warranty repair or replacement is necessary within the 12 months after completed purchase (warranty period), Customer must contact Company at: TechSupport@blkchp.com Making sure to reference proof of purchase (Shop receipt or invoice), RMA number, date of purchase and operational issues with the system, or product under warranty.  Company will make every effort to reply to all inquiries within 48 hours of receiving the initial email.

Exclusion Of Damages (Disclaimer)

  1. Company's sole obligation and liability under this warranty is limited to the repair or replacement of a defective product at our option. Company shall not, in any event, be liable for any incidental or consequential damage, including but not limited to damages resulting from interruption of service and loss of data, business, or for liability in tort relating to this product or resulting from its use or possession.

 Limitations Of Implied Warranties

  1. There are no other warranties, expressed or implied, including but not limited to those of merchantability or fitness for a particular purpose. The duration of implied warranties is limited to the warranty length previously specified.

  2. Please note that our warranty is not an unconditional guarantee. If the product, in Company's opinion, malfunctions within the warranty period, Company will at its discretion repair or replace the product depending on availability. Warranty does not cover any Company product that was damaged due to accident, misuse, abuse, improper installation by Customer,, usage not in accordance with product specifications and instructions, natural or personal disaster, or unauthorized alterations, repairs or modifications. Warranty does not cover items of Apparel. Warranty does not cover the following: Any product or serial number/warranty sticker modification applied without permission from Company, as well as any damage that is not a manufacturing defect. Damage, deterioration or malfunction resulting from accident, abuse, misuse, neglect, fire, water, lightning, or other acts of nature, unauthorized product modification or failure to follow instructions included with the product. Repair or attempted repair by anyone not authorized by Company, shipping or transport damage (claims must be made with the carrier). Company does not warrant that this product will meet Customer requirements. It is Customer responsibility to determine the suitability of this product for Customer purpose. Shipping fees from initial purchase will not be refunded in any way.

Request Warranty Service

  1. To receive warranty service on purchases, Customer must submit a request at TechSupport@blkchp.com. If a technician deems the product defective or requiring testing, Customer will be required to provide a copy proof of purchase to submit an RMA request. Once approved, Customer will receive an RMA number, upon which Customer will be asked to ship the defective item back to Company with the RMA number marked or labeled on the package.Warranty/Exchanges and/or Serviceable Products that are returned to Company for review or service are shipped at cost to Customer. Company recommends that appropriate measures are taken to safeguard the product from damage when shipping.

Layaway Policy

  1. The layaway plan and associated payments are non-transferable to other customers or purchases.

  2.  By participating in the layaway program, customers agree to abide by the terms and conditions outlined in this policy.

  3. Please note that this Layaway Policy is subject to change without prior notice. The most current version of the policy will be posted on our website.

  4. Company offers a layaway program to allow customers to reserve and purchase their desired Gaming PCs through an installment plan. This policy outlines the terms and conditions of our layaway program.

  5. Any customer aged 18 or above is eligible to participate in the layaway program. International customers may also participate, but additional shipping charges may apply.

  6. Sales or Promotion Items are not eligible for Layaway, unless otherwise specified by Company.

Down Payment

  1.  Are credited towards the total purchase price. A minimum down payment of 35% of the total purchase price is required to initiate the layaway plan for computers under $1500. A minimum down payment of $500.00 is required to initiate the layaway plan for computers over $1500.00. This down payment is subject to Company Refund Policy listed above.

 

Payment Schedule

  1.  Customers are requested to make equal size payments towards the remaining balance of their layaway purchase over a 12-16 months.

 

Completion Period

  1.  The maximum duration for the layaway plan is 16 months. Customers must complete payments and fully purchase any products to include Gaming PC within this period.

 

Order Fulfillment

  1. Once the full payment is received, Company will process and ship purchased items to the customer's designated shipping address.

 

Online Layaway 

  1. Customers can initiate and manage their layaway plan online through Company’s official website. Online payments can be made using credit cards or electronic payment methods.

 

ALL SALES ARE FINAL

 

Layaway Cancellation Policy

  1. Customer Layaway Cancellation Policy If a customer decides to cancel their layaway plan, a 10% cancelation fee will be applied to the down payment and any subsequent payments any remaining balance will be converted into store credit, valid for future purchases at BLKCHP.COM to be used towards the purchase of another system, parts, subscriptions, events and/or merchandise. 

 

Availability

  1. The availability of specific Gaming PC models for layaway may vary and is subject to stock availability.

 

Price Changes

  1. If the price of the selected Gaming PC changes during the layaway period, the customer will not be affected and is only liable for the original price agreed upon at the start of the layaway plan.

 

Payment Amount

  1. Customers may modify their payment amounts during the layaway period, provided the revised amount does not extend the completion period beyond 5 Years.

 

Privacy Policy: 

  1. Company is committed to implementing appropriate protections for any information that we collect or our users share with us. We are based in the United States. We store information about users of our Services on servers located in the United States and in other countries.

  2. Our Services, including any software used, collect both personal, non-personal and other information, about Customer and the computer system Customer use ("User System") as described below.

Children

  1. You must be 13 years of age or older to access or use our Services. We do not knowingly collect or maintain the personal information of children under the age of 13. Anyone under the age of 13 is not permitted to access or use the Services and must not attempt to register an account or submit any personal information to us. We will take appropriate steps to delete the personal information of persons under the age of 13 once brought to our attention. If Customer suspects a child or a minor under the age of 13 has violated this policy please write to us at privacypolicy@blkchp.com with the name and account number in question. 

  2. For a full list of the types of personal information and other data collected by BLKCHP.COM please email Customer request for information to privacypolicy@blkchp.com and we will reply in course. 

 

Financial Data

  1. If Customers are using the websites to purchase products or services, Customers will also provide payment details, which may include billing addresses, credit/debit card details and bank account details.

 

Photos

  1.  If Customer chooses to share photos with us, then Customer may provide personal information in the form of photos of Customer or other people.

 

Feedback and reviews

  1. If Customer posts on our websites, then Customer will provide details of any personal data that Customer shares in the post, for instance, Customer username, Customer opinions, Customer experiences etc.

 

Employment and background data

  1. If Customer are submitting a job application, Customer may provide information about Customer resume, cover letter, work availability dates, desired pay level, a link to Customer website/blog/portfolio, a link to CustomerCustomer LinkedIn profile, Customer academic and work history, qualifications, skills, projects and research that Customer are involved in, answers to specific questions we ask in relation to the role Customer are applying for, references, proof of CustomerCustomer entitlement to work (e.g. passport and visa), CustomerCustomer national security number, drivers license, other identity document details, and any other such similar information that Customer may provide to us.

 

Survey data

  1.  From time to time we might ask if Customer would be willing to participate in our surveys; if Customer agrees, we will also collect any information that Customer provides as part of that survey.

 

Technical and system-related data. 

  1. In relation to CustomerCustomer use of our services or interactions with us, we will collect information such as CustomerCustomer region, the specification and components of Customer PC, Customer chosen language and IP address.


 

Information we collect about Customer

  1. When Customers access or use our Services, we may collect personal information about Customers. This can include traditional identifiers such as name, address, e-mail address, telephone number and non-traditional identifiers such as unique device identifiers and Internet Protocol (IP) addresses. We may collect personal information, and non-personal and other information that Customer or others give us, or allow us to receive either through preferences settings in Customer computer, device, or browser, from third parties such as social networks, or through the use of our Services (e.g. the pages Customer visit or the elements of our Services Customer use). The following are examples of the categories and types of personal information, non-personal and other information we may collect.

  2. Information contained in correspondence

  3. We will collect any information contained in any correspondence between us. For example, if Customer contacts us using a form on our websites, by raising a ticket for customer service, by email or telephone, we may keep a record of that correspondence; Website usage data. We will collect information about Customer interactions with the websites, including information such as login data, IP address, page views, searches, requests, orders, pre-approvals, confirmations, agreements between Customer and other website users and other actions on the websites.

Technical data. 

  1. We will also collect certain information about how Customers use our websites and the device that Customers use to access our websites, even where Customers have not created an account or logged in. This might include Customer geographical location, device information (such as Customer hardware model, mobile network information, unique device identifiers), the data transmitted by Customer browser (such as Customer IP address, date and type of the request, content of the request regarding the specific site, time zone settings, access status/HTTP status code, volume of data transmitted, browser type and version, language settings, time zone settings referral source, length of visit to the websites, date and time of the request, operating system and interface) number of page views, the search queries Customer make on the websites and similar information. This information may be collected by a third-party website analytics service provider on our behalf and/or may be collected using cookies or similar technologies. For more information on cookies please read the COOKIES section below.

  2. In certain circumstances, we will receive information about customers from third parties. 

 

Users of our Service. 

  1. We may receive personal information from other users of our Service, including website users, who may be based inside or outside the EU, for example information that is posted or uploaded by other users (e.g. reviews, comments), information relating to transactions and/or correspondence between website users.

  2. Third party retailers We sell some of our products through third party retailers. We may receive personal information in relation to transactions made through these retailers, such as details of orders, returns and refunds requested.

  3. Marketing partners. We might also receive information about Customer from third parties if Customer has indicated to such third party that Customer would like to hear from us.

  4. Service providers. We may collect personal information from our website developer, IT support provider, and payment services provider.

  5. Fraud detection agencies. Where permitted or required by law, we may receive information about Customers, including demographic data or fraud detection information from third party service providers and/or partners who are based inside and outside the EU.

  6. Website and Service security. We will collect information from our website security service partners who are based outside the EU, about any misuse to the website, for instance, the introduction of viruses, Trojans, worms, logic bombs, website attacks or any other material or action that is malicious or harmful.

  7. Social media plugins. We currently use social media plugins from the following service providers who are based both inside and outside the EU: Facebook, Google+, Twitter, and LinkedIn. By providing Customer social media account details Customer are authorizing that third-party provider to share with us certain information about Customer.

 

Information Use

  • We will use Customer information for the purposes listed below either on the basis of:

    •  performance of Customer contract with us and the provision of our services to Customer;

    •  Customer consent (where we request it)

    •  where we need to comply with a legal or regulatory obligation

    • our legitimate interests or those of a third party (see section 2.4 below)

    • We use personal information and other data collected for the following purposes:

    • to communicate with Customer when Customer contact us, submit enquiries or provide feedback, or to contact Customer directly about products or services Customer have ordered (on the basis of our legitimate interest in communicating with users and customers)

    • To provide Customers with access to our websites in a manner convenient and optimal and with personalized content relevant to Customer including sharing Customer information with our website hosts and developers (on the basis of our legitimate interest to ensure our websites are presented in an effective and optimal manner).

    • To create and maintain Customer accounts and allow access to our Services (on the basis of performing our contract with Customer).

    • To process and facilitate transactions and payments, and to collect and recover money owed to us (on the basis of performing our contract with Customer and on the basis of our legitimate interest to recover debts due).

    • To provide technical customer support and respond to user inquiries (on the basis of our contract with Customer or on the basis of our legitimate interests to provide Customer with customer service), to deal with enquiries or complaints about the Service and share Customer information with our website developer, IT support provider, and payment services provider as necessary to provide customer support (on the basis of our legitimate interest in providing the correct products and services to our Service users and to comply with our legal obligations).

    • To manage our relationship with Customer, which will include notifying Customer about changes to our terms of use or Privacy Policy, and asking Customer to leave a review or take a survey (on the basis of performing our contract with Customer, to comply with our legal obligations and on the basis of our legitimate interests to keep our records updated and study how our websites and services are used)

    • Solicit input and feedback to improve our products and services and customize Customer user experience (on the basis of our legitimate interest in providing the right kinds of products and services to our customers).

    • To enable Customer to take part in prize draws, competitions and surveys (on the basis of performing our contract with Customer and our legitimate interest in studying how our websites and services are used, to develop them and grow our business).

    •  To keep in contact with Customer about our news, events, new Service features, and products or services that we believe may interest Customer, provided that we have the requisite permission to do so, and sharing Customer information with our marketing services provider (either on the basis of Customer consent where we have requested it, or our legitimate interests to provide Customer with marketing communications where we may lawfully do so).

    • To deliver relevant website content and advertisements to Customer and measure or understand the effectiveness of the advertising we serve to Customer (on the basis of our legitimate interests in studying how our websites/services are used, to develop them, to grow our business and to inform our marketing strategy).

    • To make suggestions and recommendations and share Customer information with selected third parties such as suppliers and partners, to enable them to contact Customer with information about things that may interest Customer (where we have Customer consent to do so).

    • To interact with users on social media platforms including Facebook, LinkedIn, Twitter, Instagram, YouTube, Twitch, Steam, Reddit, Discord, and Google+ and, for example, responding to comments and messages, posting, ‘retweeting’ and ‘liking’ posts (on the basis of our legitimate interest in promoting our brand and communicating with interested individuals).

    • To carry out aggregated and anonymised research about general engagement with our websites (on the basis of our legitimate interest in providing the right kinds of products and services to our website users).

    • To use data analytics to improve our Service and products, marketing, customer relationships and experiences (on the basis of our legitimate interests in defining types of customers for our websites and services, to keep our websites updated and relevant, to develop our business and to inform our marketing strategy).

    • To protect, investigate, and deter against fraudulent, unauthorized, or illegal activity, including activities that are, or may be, in breach of our Terms of Use or applicable law, or investigating and preventing identity fraud (on the basis of our legitimate interests to operate a safe and lawful business or where we have a legal obligation to do so).

    • To enable us to comply with our policies, procedures and with law, to enforce our legal rights, or to protect the rights, property or safety of our employees and workers and share Customer information with our technical and legal advisors (on the basis of our legitimate interests to operate a safe and lawful business or where we have a legal obligation to do so).


 

  1. As outlined above, in certain circumstances we may use Customer personal information to pursue legitimate interests of our own or those of third parties. When we refer to using Customer information on the basis of our “legitimate interests”, we mean our legitimate business interests in conducting and managing our business and/or our relationship with Customer.

  2. Should Company ever require the collect of “Special Category Information”: “special categories” of particularly sensitive personal information (this includes details about Customer race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about Customers health and genetic and biometric data) and information about criminal convictions and offenses requires higher levels of protection. Company has in place an appropriate policy document and safeguards which we are required by law to maintain when processing such data. 

 

Information Sharing and Disclosure

  1. In connection with the purposes and on the lawful grounds described above and in addition to the recipients of Customer information as described above, we will share Customers personal information when relevant with third parties. We require third parties to maintain appropriate security to protect Customer information from unauthorized access or processing.Please write to privacypolicy@blkchp.com for a full list of third parties. 

 

Cookies and Tracking Technologies

  1.  We use standard tracking technologies like cookies, pixels and local storage, to collect certain types of personal and non-personal information, including: (i) which of our web pages, apps and other Services Customer access; (ii) information about Customer mobile device (such as device and browser type); and (iii) Customer Internet protocol address, search query and other information relating to Customer use of our websites. We collect these types of information to help us provide Customers a more personalized and relevant online experience including by remembering Customer preferences and providing personalized content.

  2. Our websites may contain content and links to other sites that are operated by third parties that may also operate cookies. We don’t control these third party sites or cookies and this Privacy Policy does not apply to them. Please consult the terms and conditions and Privacy policy of the relevant third party site to find out how that site collects and uses Customer information and to establish whether and for what purpose they use cookies.

  3. Please note that we may need to retain certain information for our own record-keeping and research purposes. We may also need to send Customer service-related communications relating to Customer user accounts even when Customer has requested not to receive marketing communications.

  4. If Customer has already registered an account, Customer may cancel any Account registered to Customer at any time by submitting a support ticket via our support site.

 

What we need from Customer to process Customer requests

  • We may need to request specific information from Customer to help us confirm Customer identity and to enable Customer to access Customer personal data. This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact Customer to ask Customer for further information in relation to Customer request to speed up our response.

 

 Data Usage 

  1.  We use data to improve Customer experience while using our products, such as storing Customer preferences and settings when Customers use our software. We also use data to determine what type of hardware Customers have and what games Customers play so that we can do things like offering recommendations for improving the performance of the Customer system or reducing noise. 

  2. We will retain Customer information for as long as is necessary to provide Customer with the services that Customer has requested from us or for as long as we reasonably require to retain the information for our lawful business purposes, such as for the purposes of exercising our legal rights or where we are permitted to do. 

  3. We use this data to secure Customer accounts, to identify the data that is associated with it, such as Customer settings and hardware configuration, and to enable Customer to only have to sign-in once while using our sites. We also use this data to analyze engagement to help determine how we can improve the usage of our products.

Help keep Customer information safe:

  • We urge Customers to take steps to keep Customers personal information safe (including Customer account password), and to logout of Customer account after use. If a Customer TPS account is hacked, this may lead to unauthorized access, so be careful to keep Customer account information secure. You can also play a part in keeping Customers information safe by:

  •  

  • choosing a strong account password and changing it regularly

  • using different passwords for different online accounts

  • keeping Customer login and password confidential and avoiding sharing these details with others;

  • making sure Customer log out of the website each time Customer have finished using it. This is particularly important when using a shared computer;

  • letting us know if Customer know or suspect that Customer account has been compromised, or if someone has accessed Customer account without Customer permission;

  • keeping Customers devices protected by using the latest version of Customers operating system and maintaining any necessary anti-virus software; and

  • being vigilant to any fraudulent emails or sms messages that may appear to be from us. Any emails that we send will come from an email address ending in ‘@blkchp.com’ or our sms notification ID.

  1. Company shares Customer personal data within the BLKCHP Group to Include BLKCHP Gaming Systems, BLKCHP.COM, BLKCHP Publications Ltd, BLKCHP Consulting llc, BLKCHP Holdings Group llc,, BLKCHP UK LTD,  BLKCHP, Inc. This can involve a transfer of data outside the EEA.

  2. External third parties may be based outside the European Economic Area (EEA) so their processing of Customer personal data will involve a transfer of data outside the EEA.

  3. Where we use providers based in the US, we may transfer data to them if they are part of the Privacy Shield which requires them to provide similar protection to personal data shared between Europe and the US. For further details, see European Commission: EU-US Privacy Shield.

California Users – Do Not Track

  1. California law gives its residents the right to request information regarding the types of consumer personal information that this site collects and shares with third parties for direct marketing purposes. If Customer is a California resident, Customer may make a request to us by email at systems@blkchp.com. Please include My California Privacy Rights in the subject line of Customer email and allow 30 days for us to respond. Because there is no accepted standard on how to respond to Do Not Track signals, we do not respond to such signals.

 

Sharing data directly with third parties 

  1. Should Customer provide personal information directly to third parties as a consequence of Customer interactions with our Services, websites and other services offered by the Company. Company is not responsible for how such third parties use personal data provided by Customer.

 

  1.  Please be responsible with the personal information of others when using our websites and the services available on it. We are not responsible for Customer misuse of personal information, or for the direct relationship between Customer and others when it takes place outside of the websites or our services.

 

Third-party links

  1. The websites may include links to third-party websites, plug-ins and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about Customer. We do not control these third-party websites and are not responsible for their privacy statements. When Customer leave our websites, we encourage Customer to read the privacy policy of every website Customer visits.

 

Changes
